The Rules of this Contest
Listed below are extracts from the rules of this competition which is being promoted by the U.S. Embassy in Prague, Czech Republic. These extracts detail the rights being claimed from entrants.
"4. Sout?žící poskytuje organizátorovi souhlas k užití fotografií k propagaci sout?že a souhlasí s publikováním zaslaných fotografií v tiskové nebo v elektronické podob? v rámci sout?že bez nárok? na honorá?, a to v tiskovinách vydávaných organizátorem sout?že ale i v rámci jiných reklamních a propaga?ních prost?edk?, souvisejících se sout?ží.
5. Fotografie budou použity pouze v souvislosti se sout?ží a výhradn? nekomer?n?. Tento souhlas sout?žící organizátorovi poskytuje na dobu p?ti let. Jakkoliv zve?ejn?né fotografie vždy ponesou kredit svých autor?.
5. Organizátor si vyhrazuje právo zm?nit podmínky sout?že nebo ji zrušit. Na výhru v sout?ži není právní nárok. Organizátor m?že rozhodnout o p?ípadném nezve?ejn?ní p?ihlášených fotografií nebo jejich vy?azení ze sout?že, p?ípadn? u?init v rámci sout?že jiná opat?ení; p?edevším jedná-li se o fotografie pohoršující nebo neetické.
6. Komise ve složení Ji?í Turek (profesionální fotograf), Martin Holcman (CANON ?R) a Miroslav Konvalina (Americké centrum) vyhodnotí snímky a vyhlásí vít?ze sout?že do konce ?íjna 2008, nejlepším fotografiím bude uspo?ádána výstava v prostorách Amerického centra."
The above written in Czech on the competition website has been translated into English by Google as follows -
"4. Contestants provides organizer consent to the use of photographs to promote competition and agrees with the publication of photos sent in print or in electronic form in the competition without any claims for fees, in the press issued by the organizer of competition but also in other advertising and promotional tools associated with competition.
5. Photographs will be used only in the context of the competition and only non-commercially. Tento.. However, published photos always bear the credit of their authors.
5. Organizer reserves the right to modify the conditions of competition or cancel it. The win in the competition is not a legal claim. Organizer may decide not to publish any photographs of applicants or their exclusion from the competition, possibly in the competition to make other arrangements, especially in the case of photos pohoršující or unethical.
6. Commission composed of Jiri Turek (professional photographer), Martin Holcman (CANON CR) and Miroslav Konvalina (American Center) evaluate the pictures and publish the winner of competition by the end of October 2008, the best photo exhibition will be held in the American Center. - seek waiving of moral rights
- fail to give a credit for all free usage

- seek usage rights other than for solely and exclusively promoting the contest. Note that a book, posters, cards, or a calendar are seen as legitimate ways of promoting the contest and defraying costs
- seek free usage rights in excess of 3 years
- use the works commercially without the creators agreement, and such commercial usage is to be rights managed and limited to 3 years.
- make it a condition of winning that an entrant must sign a commercial usage agreement
- fail to publish all documents on the competition website that an entrant may have to sign
- fail to name the judges for this or last year's competition
- fail to explicitly state all the organisations who will acquire rights to the works
- set a closing date more than 18 months after the contest launch date
- fail to make clear statements of rights claimed and how the works are used
